This Stallion Service contract
certifies that _______________________________,
hereinafter designated Mare Owner, agrees to breed the
mare ____________________________, Breed _____________,
Registration No.___________________ to the stallion
Wincredible, for the breeding season of 2006 at
$___________, with a live foal guarantee. The
breeding season in force for this contract shall begin
February 14th, 2006 and end June 15th,
2006 of the year covered by this contract. Buddy Talbert,
agent for the above named stallion, will herein be
referred to as Breeder.
1. A non-refundable booking fee of $__________of the
above fee is payable with this contract and the
non-refundable balance of $____________plus all
unpaid expenses will be payable upon receipt of an
invoice or when the mare leaves the farm, whichever is
first. The Breeder requires 48 hours advance notice
when the Mare Owner wishes to remove his/her mare(s) from
the farm. This will allow Breeder sufficient time to
prepare the final statement so the Mare Owner may settle
his/her account.
2. A photostatic copy of the registration papers (both
sides), a current negative coggins, a veterinarians
health certificate, plus health, worming and immunization
records must be presented upon arrival of mare. If not,
the Breeder will make proper arrangements for tests
and/or exams, at the Mare Owners expense.
3. The Breeder will exercise judgment as to the care and
supervision of mare and/or foal. Breeder assumes
responsibility for arranging veterinarian and farrier
services as need at Mare Owners expense.
4. Mare Owner agrees that the mare shall be healthy, in
sound breeding condition and free from infection or
disease. Breeder reserves the right to refuse mare if not
in satisfactory condition. Mare Owner may substitute
another mare within that same breeding season.
5. Breeder agrees to diligently try to settle mare;
however, if mare fails to settle, for any reason, Mare
Owner will hold Breeder blameless. Mare Owner agrees to
give Breeder ample opportunity to settle mare. There will
be no guarantee of a live foal for any mare leaving Buddy
Talbert Quarter Horses before being checked safe in foal
by the attending veterinarian. If mare leaves premises
before being pregnancy checked, the live foal guarantee
becomes VOID and all unpaid balances are due and payable.
Mare Owner agrees that stallion owner and/or manager does
not make any guarantees as to the quality or conformation
of the foal nor, that the foal will be free of any
infirmity, conformation defect, disease, or inherited
trait.
6. This contract holds a live foal guarantee; in which a
live foal is described as a newborn foal which stands and
nurses without assistance. It is understood that if the
mare proves barren, aborts her foal of if the foal is
stillborn, a return privilege will be granted for the
current or the following breeding season only.
Breeder must be notified, and written verification by a
licensed veterinarian is required within 7 days, that the
mare has slipped or has produced a non-viable foal. Mare
Owner certifies that such abortion or death did not
result from any act or omission of the Owner subsequent
to the mares departure from Buddy Talbert Quarter
Horses.
7. Mare Owner and Breeder agree that should the above
mentioned stallion die, or become unfit for service, or,
if the above mentioned mare dies, or becomes
incapable of breeding, then the Mare Owner may substitute
another mare or breed the above named mare to
another stallion on the farm that is agreed to by both
the Breeder and the Mare Owner.
8. Both parties agree that Buddy Talbert Quarter Horses
(Farm), the Breeder, its owners, employees,
veterinarians, and guests shall not be liable for any
injury, escape, disability, or death of any horses on its
premises. The above named Mare Owner, whose
horse(s) are under the care of Buddy Talbert
Quarter Horses will not be liable or responsible for any
damage, injury or death to the breeding farm stallions,
employees, veterinarians, or other animals in the care of
Buddy Talbert Quarter Horses, whether or not caused by
his/her horse(s).
9. A breeders certificate will be issued to Mare
Owner after all fees/expenses have been paid in full and
upon notification of the birth of the foal.
10. This contract is entered into in the County of
Sullivan, State of Tennessee and will be interpreted and
enforced under the laws of this state. Should
either party breach this contract, the breaching party
shall pay all court fees.
11. When the above named Mare Owner signs and returns one
copy of this contract to the Breeder it will then be a
binding contract on both parties, subject to the above
terms and conditions. This contract is not valid unless
completed in full.
